The Tasmanian Government recognises the rights of land owners and users to conduct business and recreational activities involving appropriate and responsible land use practices.
To find the right balance between respecting Aboriginal heritage, recognising the importance of a range of land uses and facilitating economic development, the Tasmanian Government is committed to bringing certainty to the issue of Tasmanian Aboriginal heritage management and protection.
Integrating Tasmanian Aboriginal heritage legislation with existing management and planning processes will:
- provide a new system to protect and manage Tasmanian Aboriginal heritage integrated with existing planning and approvals processes.
- deliver certainty for all parties involved in processes for assessment, protection and management of Tasmanian Aboriginal heritage.
- promote negotiated outcomes between Tasmanian Aboriginal people and other parties in the interests of protecting heritage objects, sites and places.
- provide a new system to protect and manage Tasmanian Aboriginal heritage that is fair, transparent and inclusive.
New Tasmanian Aboriginal heritage legislation will enable enforcement of a protection and management system:
- creating appropriate offences and penalties.
- delivering incentives that assist people to meet their responsibility to protect Tasmanian Aboriginal heritage.
Investing in a system that works
Tasmanian Planning Systems was established in 1994 and encompass a range of laws aimed at achieving sustainable development in Tasmania.
Integrating new Aboriginal heritage legislation with current management and planning processes will produce a comprehensive approach - working effectively with other development and assessment processes in Tasmania.
